استقالت وزيرة الثقافة المصرية جيهان زكي اليوم (الثلاثاء) من منصبها. ووفقاً لمكتب رئيس الوزراء، فإن الاستقالة جاءت احتراماً لأحكام القضاء ولرفع الحرج عن الحكومة، بعد إدانتها بالتعدي على حقوق الملكية الفكرية.

وذكر مكتب رئيس الوزراء أن «جيهان زكي أكدت أنها تحترم أحكام القضاء، وقدمت استقالتها لرفع الحرج عن الحكومة في هذه القضية الشخصية، وستستكمل اتخاذ جميع الإجراءات القانونية المتاحة، بما في ذلك التماس إعادة النظر في الأحكام وفقاً لما يتيحه القانون، فممارسة الحقوق القانونية لا تتعارض مع احترام الأحكام القضائية».

وأعلن رئيس الوزراء المصري مصطفى مدبولي قبوله استقالة وزيرة الثقافة، متوجهاً لها بالشكر على جهودها المبذولة خلال الفترة الماضية، ومتمنياً لها التوفيق في مسيرتها.

رفضت محكمة النقض في مصر، أمس، الطعن المقدم من الوزيرة المستقيلة، وأيدت الحكم الصادر عن المحكمة الاقتصادية في 9 يوليو 2025، بإلزامها بدفع تعويض قدره 100 ألف جنيه (نحو 2000 دولار) للكاتبة سهير محمد عبدالحميد، مع سحب الكتاب محل النزاع من التداول، ليصبح الحكم نهائياً وباتاً بعد استنفاد جميع درجات التقاضي.

وأوصت نيابة محكمة النقض (وهي أعلى هيئة قضائية في البلاد وأحكامها نهائية وغير قابلة للطعن)، في مذكرتها، برفض الطعن، مؤكدة أن الحكم المطعون عليه جاء متفقاً مع صحيح القانون، وأن أسبابه كافية وسائغة، ولا تشوبها مخالفة للقانون أو فساد في الاستدلال أو قصور في التسبيب.

وأشارت محكمة النقض إلى سلامة ما انتهت إليه المحكمة الاقتصادية من ثبوت الاعتداء على حقوق الملكية الفكرية للكاتبة، معتبرةً أن ما تضمنه كتاب الوزيرة تجاوز حدود الاقتباس المباح قانوناً، بعدما أثبت تقرير اللجنة الثلاثية المنتدبة من المحكمة وجود نقل حرفي، واقتباسات مطولة، وتشابهات جوهرية في الصياغة والبناء والترتيب، بما يمس جوهر المصنف الأصلي، وليس مجرد تشابه في الأفكار أو المعلومات التاريخية التي لا تتمتع بالحماية القانونية.

وذكرت المحكمة أن مجرد الإشارة إلى المصادر والمراجع لا يكفي لنفي الاعتداء على حقوق المؤلف، إذا لم تُحدد مواضع الاقتباس بصورة واضحة، أو إذا كان النقل قد تجاوز الحدود التي يسمح بها قانون حماية الملكية الفكرية، مبينة أن الاقتباس المشروع يجب أن يظل محدوداً، وأن يحافظ على استقلالية العمل الجديد وأصالته.

وأثار اختيار زكي وزيرة للثقافة في فبراير 2026، جدلاً كبيراً بسبب الحكم الصادر ضدها من المحكمة الاقتصادية، لكن وزير الدولة للإعلام ضياء رشوان في مؤتمر صحفي لمجلس الوزراء قال: «عندما يصدر الحكم النهائي البات من محكمة النقض بالقطع، مجلس الوزراء سيجلس ويرى ما إذا كان الحكم يتواكب مع القانون في وجود الوزيرة».

The Egyptian Minister of Culture, Jihan Zaki, resigned today (Tuesday) from her position. According to the Prime Minister's office, the resignation came in respect of the court's rulings and to relieve the government of embarrassment after she was convicted of infringing on intellectual property rights.

The Prime Minister's office stated that "Jihan Zaki confirmed that she respects the court's rulings and submitted her resignation to relieve the government of embarrassment in this personal case, and she will continue to take all available legal actions, including seeking a review of the rulings in accordance with the law, as exercising legal rights does not contradict respecting judicial rulings."

Egyptian Prime Minister Mostafa Madbouly announced his acceptance of the Minister of Culture's resignation, thanking her for her efforts during the past period and wishing her success in her future endeavors.

The Court of Cassation in Egypt rejected the appeal submitted by the resigning minister yesterday and upheld the ruling issued by the Economic Court on July 9, 2025, obliging her to pay compensation of 100,000 Egyptian pounds (about 2,000 dollars) to writer Suhair Mohamed Abdelhamid, along with the withdrawal of the disputed book from circulation, making the ruling final and conclusive after exhausting all levels of litigation.

The Office of the Court of Cassation (the highest judicial authority in the country, whose rulings are final and not subject to appeal) recommended in its memorandum to reject the appeal, affirming that the contested ruling was consistent with the correct law, and that its reasons were sufficient and valid, free from any legal violations or corruption in reasoning or inadequacy in justification.

The Court of Cassation pointed out the validity of the Economic Court's conclusion regarding the infringement of the writer's intellectual property rights, considering that what was included in the minister's book exceeded the limits of legally permissible quotation, after a report from the tripartite committee appointed by the court proved the existence of verbatim copying, extensive quotations, and substantial similarities in formulation, structure, and arrangement, which affect the essence of the original work, rather than mere similarities in ideas or historical information that do not enjoy legal protection.

The court mentioned that merely referencing sources and references is not sufficient to negate infringement on the author's rights if the locations of the quotations are not clearly specified, or if the copying has exceeded the limits permitted by intellectual property protection law, indicating that legitimate quotation must remain limited and maintain the independence and originality of the new work.

The appointment of Zaki as Minister of Culture in February 2026 sparked significant controversy due to the ruling issued against her by the Economic Court, but the Minister of State for Information, Diaa Rashwan, said at a press conference for the Cabinet: "When the final ruling is issued by the Court of Cassation, the Cabinet will sit and see whether the ruling aligns with the law regarding the minister's position."
