اللائحة تجيب.. هل تخضع كل الأراضي الفارغة لـ«رسوم البيضاء»؟

كشف برنامج الأراضي البيضاء والعقارات الشاغرة أن ليس كل أرض خالية تخضع تلقائيًا لرسوم الأراضي البيضاء، مشددًا على أن هناك شروطًا محددة يجب توفرها.


وأكد البرنامج أن من بين هذه الشروط أن تكون الأرض داخل المدينة وغير مبنية وقابلة للبناء أو التطوير، إضافة إلى وقوعها ضمن النطاق الذي تم الإعلان عن الرسوم فيه.


وبين أن شروط المساحة والاستخدام تعد من العناصر الأساسية لتحديد خضوع الأرض للرسم، مؤكدًا أن الأراضي التي لا تنطبق عليها هذه الشروط لا تُحتسب ضمن العقارات الخاضعة للرسوم.


وتنص اللائحة التنفيذية لرسوم الأراضي البيضاء على أن تكون المدينة خاضعة لتطبيق الرسم عند توافر معايير منها وجود فجوة بين العرض والطلب في الأراضي المطورة، التضخم في أسعار العقارات، نقص المعروض من الأراضي المطورة، إضافة إلى احتكار الأراضي البيضاء وعدم تطويرها، نسبة الأراضي البيضاء داخل النطاق العمراني، أولويات التطوير العمراني.


ووفق اللائحة يحدد - بقرار من الوزير - داخل كل مدينة خاضعة للرسم نطاق أو نطاقات جغرافية، تشتمل على نسبة أو نسب الرسم السنوية، استخدامات الأراضي البيضاء، الحد الأدنى لمساحة الأرض ولمساحة مجموع الأراضي البيضاء داخل المدينة.


ووفق اللائحة تُحدد نسبة الرسم السنوي المستحق على الأرض البيضاء (أو مجموعة الأراضي البيضاء الواقعة ضمن النطاقات الجغرافية) وفقًا لأولويات التطوير العمراني داخل المدينة، كما يلي:


(الشريحة الأولى) ذات الأولوية القصوى، يُفرض رسم سنوي بنسبة 10% من القيمة.


ويفرض على الشريحة الثانية ذات الأولوية العالية رسم سنوي بنسبة 7.5% من القيمة، فيما يفرض على الشريحة الثالثة ذات الأولوية المتوسطة رسم سنوي بنسبة 5% من القيمة.


ومن الشرائح التي تضمنتها اللائحة الشريحة الرابعة ذات الأولوية المنخفضة يُفرض رسم سنوي بنسبة 2.5% من القيمة، الشريحة الخامسة خارج نطاق الأولويات لا يُفرض رسم سنوي عليها، وتحتسب ضمن مجموع الأراضي البيضاء المملوكة للمكلف داخل نطاق المدينة.


وأوضحت اللائحة أن الوزارة تراجع سنويًا توافر الوحدات والأراضي والمعروض منها وحجم تداولها وأسعارها والممارسات الاحتكارية في أي مدينة أو نطاق جغرافي، لتقرير تطبيق الرسم على الأراضي فيها، أو تعديل المساحة الخاضعة للرسم، أو تعليق التطبيق، وذلك وفقًا للمعايير الواردة في الفقرة (1) من هذه المادة، وأولويات التطوير العمراني.

The White Lands and Vacant Properties Program revealed that not every vacant land automatically falls under the White Lands fees, emphasizing that there are specific conditions that must be met.


The program confirmed that among these conditions, the land must be within the city, undeveloped, and suitable for construction or development, in addition to being within the area where the fees have been announced to apply.


It clarified that the conditions of area and usage are fundamental elements in determining whether the land is subject to the fee, stressing that lands that do not meet these conditions are not counted among the properties subject to the fees.


The executive regulation for the White Lands fees states that a city is subject to the application of the fee when certain criteria are met, including a gap between supply and demand for developed lands, inflation in property prices, a shortage of developed land supply, as well as the hoarding of white lands without development, the percentage of white lands within the urban boundary, and urban development priorities.


According to the regulation, a decision by the minister determines within each city subject to the fee the geographical scope or scopes, which include the percentage or percentages of the annual fee, uses of white lands, the minimum area of land, and the total area of white lands within the city.


According to the regulation, the percentage of the annual fee due on white land (or a group of white lands located within the geographical scopes) is determined based on urban development priorities within the city, as follows:


(The first category) with the highest priority, an annual fee of 10% of the value is imposed.


The second category with high priority is subject to an annual fee of 7.5% of the value, while the third category with medium priority is subject to an annual fee of 5% of the value.


Among the categories included in the regulation is the fourth category with low priority, which is subject to an annual fee of 2.5% of the value. The fifth category, outside the priority scope, is not subject to an annual fee and is counted among the total white lands owned by the taxpayer within the city limits.


The regulation clarified that the ministry annually reviews the availability of units and lands, the supply of these lands, their trading volume, prices, and monopolistic practices in any city or geographical scope, to decide on the application of the fee on lands therein, or to adjust the area subject to the fee, or to suspend its application, in accordance with the criteria mentioned in paragraph (1) of this article, and urban development priorities.
