في حكم قضائي حاسم يعزز الردع العام، أيدت الدائرة الثانية بمحكمة الاستئناف في الكويت أحكام السجن الصادرة بحق عصابة نيجيرية نفذت عملية سطو درامية وسرقة محل صرافة في منطقة «المهبولة»، باستعمال سلاح وهمي ومخطط محكم لتوزيع الأدوار وإخفاء الأموال المسروقة.

وكشفت تحقيقات النيابة العامة الكويتية كواليس الجريمة والأدوار التي تقاسمها المتهمون الخمسة للسيطرة على محل الصرافة ونهب أمواله:

• التهديد بالسلاح المزيف: اقتحم المتهم الثاني محل الصرافة شاهراً «مسدساً مزيفاً» لإرهاب العاملين وشل قدرتهم على المقاومة أو الاستغاثة.
• الاستيلاء والتنفيذ: مكن المتهم الأول زميليه (الثالث والرابع) من الدخول والاستيلاء السريع على المبالغ المالية الموجودة داخل الصرافة.
• إخفاء المسروقات والتمويل: اقتصر دور المتهم الخامس على الاشتراك والاتفاق المسبق، وتولي مهمة إخفاء الأموال المسروقة وتزويد بقية عناصر العصابة بالحصيلة المالية الناجمة عن الجريمة.

وصدر الحكم برئاسة المستشار نصر سالم آل هيد، وعضوية المستشارين متعب العارضي وسعود الصانع، ليؤيد كلياً قرار محكمة الجنايات الأولية:

• المتهمون (من الأول إلى الرابع): الحبس لمدة 7 سنوات (حضورياً للمتهم الأول، وغيابياً للمتهمين الثاني والثالث والرابع الذين لا يزالون فارين).
• المتهم الخامس: الحبس لمدة 6 أشهر، بعد أن قامت المحكمة بتعديل الوصف وقيد الاتهام الموجه إليه، نظراً لاقتصار دوره على إخفاء المسروقات والاشتراك المعاون.

In a decisive judicial ruling that enhances general deterrence, the Second Circuit of the Court of Appeals in Kuwait upheld the prison sentences issued against a Nigerian gang that carried out a dramatic robbery and theft of a currency exchange shop in the "Mahboula" area, using a fake weapon and a well-planned scheme to distribute roles and hide the stolen money.

The investigations by the Kuwaiti Public Prosecution revealed the details of the crime and the roles shared by the five defendants to control the currency exchange and loot its funds:

• Threatening with a fake weapon: The second defendant stormed into the currency exchange brandishing a "fake gun" to terrorize the employees and incapacitate their ability to resist or call for help.
• Seizing and executing: The first defendant enabled his two colleagues (the third and fourth) to enter and quickly seize the amounts of money present inside the exchange.
• Hiding the stolen goods and financing: The role of the fifth defendant was limited to participating and pre-agreeing, taking on the task of hiding the stolen money and providing the other members of the gang with the financial proceeds resulting from the crime.

The ruling was issued under the presidency of Counselor Nasr Salem Al-Haid, with the membership of Counselors Muteb Al-Araidi and Saud Al-Sa'ani, fully affirming the decision of the Primary Criminal Court:

• The defendants (from the first to the fourth): imprisonment for 7 years (in person for the first defendant, and in absentia for the second, third, and fourth defendants who are still at large).
• The fifth defendant: imprisonment for 6 months, after the court amended the description and the charge against him, due to the limitation of his role to hiding the stolen goods and being an accomplice.
