في واقعة مثيرة، أمرت النيابة الإدارية في مصر، اليوم (الثلاثاء) بإحالة أخصائية اجتماعية ومدير سابق لإحدى المدارس الابتدائية بمحافظة الشرقية إلى المحاكمة التأديبية، وذلك بسبب تقاعسهما عن اتخاذ الإجراءات القانونية اللازمة تجاه واقعة تحرش جنسي تعرض لها تلميذ في الصف الثاني الابتدائي على يد تلميذ آخر في الصف السادس الابتدائي، داخل مقر المدرسة أثناء اليوم الدراسي خلال العام الدراسي 2024/2025.
شكوى والدة التلميذ
تلقت نيابة منيا القمح الإدارية شكوى من والدة التلميذ المتضرر، أفادت فيها بتكرار تعرض نجلها للتحرش الجنسي من قبل تلميذ بالصف السادس، مع تقاعس المسؤولين بالمدرسة عن اتخاذ الإجراءات القانونية المطلوبة.
وخلال التحقيقات، استمعت النيابة إلى أقوال والدة التلميذ، التي أكدت تعرض نجلها للتحرش باستخدام القوة والإكراه والتهديد داخل المدرسة، حيث تتبعه التلميذ المعتدي أثناء ذهابه إلى دورة المياه، ثم أغلق الباب من الداخل وباغته بالتحرش الجنسي، مهددًا إياه بالانتقام إذا أفشى السر.

وعندما علمت الأم بالواقعة توجهت إلى المدرسة للإبلاغ، وقام نجلها بالتعرف على المعتدي، فأخبرها مدير المدرسة بأنه سيتم اتخاذ الإجراءات القانونية وفصله، لكن لم يحدث شيء، وتكرر الفعل مرة أخرى من التلميذ نفسه دون أي إجراء، مما دفعها لتحرير محضر إداري بقسم الشرطة.
واستمعت النيابة أيضًا إلى شهادات عدد من العاملين بالمدرسة والإدارة التعليمية، وشكلت لجنة من قسم التوجيه المالي والإداري لفحص الواقعة وتحديد المسؤولين، والتي انتهت إلى ثبوت مخالفة المتهمين للائحة الانضباط المدرسي الصادرة عن وزارة التربية والتعليم والتعليم الفني، حيث قاما بإجراءات صورية لستر تقاعسهما عن واجبهما الوظيفي، دون الاكتراث بمسؤولياتهما في حماية التلاميذ وتوفير بيئة تعليمية آمنة.
تقاعس وتزوير مستندات
وكشفت التحقيقات أن الأخصائية الاجتماعية تقاعست عن اتخاذ الإجراءات المقررة قانونًا بعد علمها بالواقعة، بل اصطنعت مستندات وهمية لتغطية تقاعسها، شملت: محضر اجتماع وهمي للجنة الحماية المدرسية، خطاب استدعاء ولي أمر التلميذ المعتدي، وقرار فصله لمدة 15 يومًا، دون إخطار الجهات المعنية بالقرار المزعوم، مما أدى إلى استمرار حضور التلميذ المعتدي للمدرسة، وكذلك تقاعس المدير السابق عن اتخاذ الإجراءات المقررة، بل اعتمد محضرًا صوريًا لاجتماع لجنة الحماية بخاتمه الرسمي، يفيد بفصل التلميذ المعتدي لمدة 15 يومًا خلافًا للحقيقة، مما سمح باستمرار حضوره.
إحالة المتهمين إلى المحاكمة
وبناءً على ما انتهت إليه التحقيقات من مخالفات جسيمة، وبعد العرض على فرع الدعوى التأديبية بالزقازيق، تقررإحالة المتهمين إلى المحاكمة التأديبية العاجلة.
وأهابت النيابة الإدارية بالقائمين على العملية التعليمية ضرورة تفعيل لائحة التحفيز التربوي والانضباط المدرسي الصادرة عن وزارة التربية والتعليم والتعليم الفني، مع التركيز على تركيب وتفعيل منظومة كاميرات المراقبة في الأماكن المسموح بها قانونًا (خصوصا الممرات المؤدية للفصول والمكاتب الإدارية ودورات المياه ومداخل المباني)، وتفعيل دور المشرفين والمرور اليومي لضمان إحكام الرقابة والإشراف داخل المؤسسات التعليمية.
In a dramatic incident, the Administrative Prosecution in Egypt ordered today (Tuesday) the referral of a social worker and a former principal of a primary school in Sharqia Governorate to disciplinary trial due to their failure to take the necessary legal actions regarding a sexual harassment incident that a second-grade student was subjected to by another student in the sixth grade, inside the school premises during the school day in the 2024/2025 academic year.
Complaint from the Student's Mother
The Minya al-Qamh Administrative Prosecution received a complaint from the mother of the affected student, in which she reported the repeated sexual harassment of her son by a sixth-grade student, along with the negligence of the school officials in taking the required legal actions.
During the investigations, the prosecution listened to the testimony of the student's mother, who confirmed that her son was subjected to harassment using force, coercion, and threats inside the school, where the offending student followed him to the bathroom, then locked the door from the inside and assaulted him sexually, threatening him with revenge if he revealed the secret.
Details of the Incident
When the mother learned of the incident, she went to the school to report it, and her son identified the assailant. The school principal informed her that legal actions would be taken and the student would be expelled, but nothing happened, and the act was repeated by the same student without any action, which led her to file an administrative report at the police station.
The prosecution also listened to the testimonies of several school staff and educational administration members, and formed a committee from the financial and administrative guidance department to investigate the incident and identify the responsible parties. The committee concluded that the accused violated the school discipline regulations issued by the Ministry of Education and Technical Education, as they took superficial actions to cover up their negligence of their duties, without regard for their responsibilities in protecting students and providing a safe educational environment.
Negligence and Document Forgery
The investigations revealed that the social worker failed to take the legally required actions after learning of the incident, and even fabricated false documents to cover up her negligence, which included: a fictitious meeting report for the school protection committee, a letter summoning the guardian of the offending student, and a decision to expel him for 15 days, without notifying the relevant authorities of the alleged decision, which allowed the offending student to continue attending school. Additionally, the former principal failed to take the required actions and relied on a fictitious report of a protection committee meeting with his official seal, stating that the offending student was expelled for 15 days, contrary to the truth, which allowed him to continue attending.
Referral of the Accused to Trial
Based on the serious violations concluded by the investigations, and after being presented to the disciplinary lawsuit branch in Zagazig, it was decided to refer the accused to urgent disciplinary trial.
The Administrative Prosecution urged those involved in the educational process to activate the educational motivation and school discipline regulations issued by the Ministry of Education and Technical Education, focusing on the installation and activation of surveillance camera systems in legally permissible areas (especially the corridors leading to classrooms, administrative offices, bathrooms, and building entrances), and to enhance the role of supervisors and daily monitoring to ensure strict oversight and supervision within educational institutions.
