لوّح عمدة مدينة نيويورك، زهران ممداني، بأنه يدرس مع المستشارين القانونيين في المدينة ما إذا كانت إدارته تمتلك الصلاحية القانونية لاتخاذ إجراءات بحق رئيس الوزراء الإسرائيلي بنيامين نتنياهو، في حال زيارته نيويورك للمشاركة في اجتماعات الجمعية العامة للأمم المتحدة المقررة في سبتمبر القادم.
وفي مقابلة مع صحيفة نيويورك تايمز، أكد ممداني أن نتنياهو «ينبغي أن يكون في لاهاي»، في إشارة إلى مقر المحكمة الجنائية الدولية، التي أصدرت في نوفمبر 2024 مذكرة توقيف بحقه على خلفية اتهامات بارتكاب جرائم حرب وجرائم ضد الإنسانية خلال الحرب في قطاع غزة.
وقال ممداني إن موقفه يستند إلى مذكرة التوقيف الصادرة عن المحكمة الجنائية الدولية، مضيفًا أن «هناك كثيرين يشاركون هذا الرأي بالنظر إلى ما أسفرت عنه سياسات وأفعال نتنياهو خلال السنوات الماضية».
وأوضح عمدة نيويورك أنه لا يزال غير متأكد مما إذا كان يمتلك السلطة القانونية لإصدار أوامر إلى شرطة نيويورك لاحتجاز زعيم أجنبي يتمتع بوضع دبلوماسي، لكنه كشف عن وجود «نقاشات نشطة» مع الإدارة القانونية للمدينة لدراسة جميع الخيارات المتاحة.
وأضاف: «سنلتزم بما يسمح به القانون في مدينة نيويورك، ولن نقوم بصياغة قوانين جديدة لهذا الغرض».
وكانت المحكمة الجنائية الدولية قد أصدرت مذكرة توقيف بحق نتنياهو وعدد من المسؤولين الإسرائيليين، متهمة إياهم بارتكاب جرائم حرب وجرائم ضد الإنسانية، من بينها استخدام التجويع كسلاح حرب، والقتل، والاضطهاد، وأفعال وصفتها المحكمة بأنها غير إنسانية بحق المدنيين في قطاع غزة.
وخلال حملته الانتخابية لرئاسة بلدية نيويورك، وصف ممداني العمليات العسكرية الإسرائيلية في غزة بأنها «إبادة جماعية»، كما وصف نتنياهو بأنه «مجرم حرب»، مؤكدًا آنذاك أنه سيوجه شرطة المدينة لاعتقاله إذا زار نيويورك.
وفي المقابل، أدان هجوم حركة حماس على إسرائيل في 7 أكتوبر 2023، واعتبره «جريمة حرب مروعة».
لكن خبراء قانونيين نقلت عنهم صحيفة نيويورك تايمز رأوا أن تنفيذ مثل هذا الإجراء سيكون «شبه مستحيل من الناحية العملية»، وقد يضع عمدة المدينة في مواجهة مباشرة مع الحكومة الفيدرالية الأمريكية.
ولا تعترف الولايات المتحدة باختصاص المحكمة الجنائية الدولية، إذ إنها ليست عضوًا فيها، كما فرض الرئيس الأمريكي دونالد ترمب، في فبراير 2025، عقوبات اقتصادية على المحكمة، معتبرًا أنها لا تمتلك ولاية قضائية على الولايات المتحدة أو إسرائيل.
وفي السياق ذاته، تعهد وزير الخارجية الأمريكي ماركو روبيو بالعمل على «تفكيك» المحكمة، متهمًا إياها بشن «حرب قانونية» ضد الولايات المتحدة عبر توظيف ما وصفه بـ«القانون الدولي المزعوم».
من جانبه، قلل نتنياهو من أهمية تصريحات ممداني، مؤكدًا في مقابلة إذاعية أنه لا يشعر بأي قلق من هذه التهديدات، كما اتهم عمدة نيويورك بدعم حركة حماس، وهو اتهام نفاه ممداني مرارًا.
وقال نتنياهو إن ممداني «يقف إلى جانب من وصفهم بالإرهابيين»، مضيفًا أن من يعادون إسرائيل واليهود «يعادون الولايات المتحدة أيضًا»، بحسب تعبيره.
بدوره، اتهم السفير الإسرائيلي لدى الأمم المتحدة، داني دانون، ممداني، أول عمدة مسلم لمدينة نيويورك، بعدم التصدي لتصاعد معاداة السامية داخل المدينة، بينما رد ممداني بالتأكيد على أنه عزز تمويل مكتب مكافحة جرائم الكراهية.
وأكد دانون أن نتنياهو سيحضر اجتماعات الجمعية العامة للأمم المتحدة في نيويورك، وسيلقي كلمة أمام المجتمع الدولي للدفاع عن موقف إسرائيل وحقها في حماية مواطنيها.
كما وصف السفير الأمريكي لدى الأمم المتحدة، مايك والتز، تصريحات ممداني بأنها «مجرد استعراض سياسي»، مشددًا على أن الولايات المتحدة ليست عضوًا في المحكمة الجنائية الدولية.
ومن المتوقع أن تستضيف نيويورك في سبتمبر القادم القادة والزعماء المشاركين في الدورة السنوية للجمعية العامة للأمم المتحدة، وهي مناسبة اعتاد نتنياهو حضورها خلال السنوات الماضية.
وفي المقابلة، شدد ممداني على أن القضية لا تتعلق بموقف شخصي من نتنياهو، بل بمذكرة توقيف صادرة عن المحكمة الجنائية الدولية، مؤكدًا أنه، بصفته عمدة نيويورك، سيلتزم بالقوانين السارية في المدينة.
وتأتي تصريحات ممداني في وقت يشهد فيه الحزب الديمقراطي الأمريكي تحولًا تدريجيًا في مواقفه تجاه الحرب في غزة.
فقد صوّت نحو نصف أعضاء الحزب في مجلس النواب أخيرا لصالح مشروع قانون يهدف إلى وقف مساعدات عسكرية لإسرائيل بقيمة 3.3 مليار دولار، ورغم فشل المشروع في الحصول على الأغلبية اللازمة، فإنه عكس تراجعًا في مستوى الدعم غير المشروط لإسرائيل داخل أوساط الحزب، وهو تحول تشير إليه أيضًا استطلاعات الرأي الأمريكية.
وفي ختام حديثه، اعتبر ممداني أن السياسة الأمريكية تجاه غزة وفلسطين «فشلت بصورة غير مسبوقة»، مشيرًا إلى أن استمرار الحرب أصبح أحد أبرز القضايا التي تؤثر في توجهات الناخبين الأمريكيين.
The Mayor of New York City, Zahraan Mamdani, has hinted that he is studying with the city's legal advisors whether his administration has the legal authority to take action against Israeli Prime Minister Benjamin Netanyahu if he visits New York to participate in the upcoming United Nations General Assembly meetings scheduled for next September.
In an interview with The New York Times, Mamdani stated that Netanyahu "should be in The Hague," referring to the International Criminal Court, which issued an arrest warrant against him in November 2024 on charges of committing war crimes and crimes against humanity during the war in Gaza.
Mamdani said his position is based on the arrest warrant issued by the International Criminal Court, adding that "there are many who share this opinion considering what Netanyahu's policies and actions have resulted in over the past years."
The Mayor of New York clarified that he is still unsure whether he has the legal authority to issue orders to the New York Police to detain a foreign leader with diplomatic status, but he revealed that there are "active discussions" with the city's legal administration to explore all available options.
He added: "we will adhere to what the law allows in New York City, and we will not draft new laws for this purpose."
The International Criminal Court had issued an arrest warrant against Netanyahu and several Israeli officials, accusing them of committing war crimes and crimes against humanity, including using starvation as a weapon of war, murder, persecution, and actions described by the court as inhumane against civilians in Gaza.
During his campaign for the New York City mayoralty, Mamdani described the Israeli military operations in Gaza as "genocide," and labeled Netanyahu as a "war criminal," asserting at the time that he would direct the city police to arrest him if he visited New York.
In contrast, he condemned the Hamas attack on Israel on October 7, 2023, calling it a "horrific war crime."
However, legal experts quoted by The New York Times believe that implementing such an action would be "virtually impossible in practice," and could put the city mayor in direct confrontation with the U.S. federal government.
The United States does not recognize the jurisdiction of the International Criminal Court, as it is not a member, and former President Donald Trump imposed economic sanctions on the court in February 2025, considering that it does not have jurisdiction over the United States or Israel.
In this context, U.S. Secretary of State Marco Rubio pledged to work on "dismantling" the court, accusing it of waging a "legal war" against the United States by employing what he described as "alleged international law."
For his part, Netanyahu downplayed Mamdani's statements, affirming in a radio interview that he feels no concern over these threats, and accused the Mayor of New York of supporting Hamas, a charge that Mamdani has repeatedly denied.
Netanyahu stated that Mamdani "stands with those he describes as terrorists," adding that those who oppose Israel and the Jews "also oppose the United States," as he put it.
Meanwhile, Israeli Ambassador to the United Nations, Danny Danon, accused Mamdani, the first Muslim mayor of New York City, of failing to address the rise of anti-Semitism within the city, while Mamdani responded by emphasizing that he has increased funding for the Hate Crimes Office.
Danon confirmed that Netanyahu will attend the United Nations General Assembly meetings in New York and will deliver a speech to the international community defending Israel's position and its right to protect its citizens.
The U.S. Ambassador to the United Nations, Mike Waltz, described Mamdani's statements as "just a political stunt," emphasizing that the United States is not a member of the International Criminal Court.
New York is expected to host leaders and dignitaries participating in the annual session of the United Nations General Assembly next September, an event that Netanyahu has traditionally attended over the past years.
In the interview, Mamdani stressed that the issue is not about a personal stance against Netanyahu, but about an arrest warrant issued by the International Criminal Court, affirming that, as Mayor of New York, he will abide by the laws in effect in the city.
Mamdani's statements come at a time when the American Democratic Party is experiencing a gradual shift in its positions regarding the war in Gaza.
About half of the party's members in the House of Representatives recently voted in favor of a bill aimed at halting military aid to Israel worth $3.3 billion, and although the bill failed to secure the necessary majority, it reflected a decline in the level of unconditional support for Israel within the party, a shift also indicated by American opinion polls.
In conclusion, Mamdani considered that the American policy towards Gaza and Palestine has "failed unprecedentedly," pointing out that the continuation of the war has become one of the most prominent issues affecting the inclinations of American voters.
