جددت النيابة العامة، عبر حسابها الرسمي في منصة «إكس» التأكيد أن جريمة التستر التجاري بكافة صورها وأشكالها تُعد مجرّمة بموجب الأنظمة المعمول بها في السعودية، وأنها تختص بالتحقيق والادعاء العام في جرائم التستر، بما يضمن حماية المصالح الاقتصادية وتعزيز الامتثال للأنظمة وحماية المجتمع من الآثار السلبية لهذه الممارسات المحظورة. وأوضحت النيابة أن التستر هو اتفاق أو ترتيب يُمكن من خلاله شخصٌ شخصاً آخر غير سعودي من ممارسة نشاط اقتصادي في المملكة غير مرخص له بممارسته باستخدام الترخيص أو الموافقة الصادرة للمتستر.
وكان البرنامج الوطني لمكافحة التستر التجاري نفذ أخيرا 2,305 زيارات تفتيشية للوقوف على امتثال أسواق النفع العام والتحقق من عدم وجود مخالفات لنظام مكافحة التستر.
وشملت الزيارات جميع مناطق المملكة، ونتج عنها ضبط 65 شبهة تستر تجاري، وتمت إحالة المخالفين إلى الجهات المختصة للتحقق وتطبيق العقوبات الرادعة بحقهم.
برنامج وطني للمكافحة
ويتمثل عمل البرنامج الوطني لمكافحة التستر التجاري في التأكد من نظامية عمل المنشآت التجارية وعدم مخالفتهم لنظام مكافحة التستر التجاري.
وتشمل مهماته تلقي شكاوى المستهلكين المتعلقة بمكافحة التستر التجاري، والتحري عن حالات مكافحة التستر وما يشتبه به، وجمع الأدلة وسماع الأقوال، والتنسيق والتعاون مع الجهات الأخرى في ما يتعلق بقضايا مكافحة التستر التجاري.
The Public Prosecution has reiterated, through its official account on the "X" platform, that the crime of commercial concealment in all its forms and manifestations is considered a crime under the laws in force in Saudi Arabia. It is responsible for investigating and prosecuting crimes of concealment, ensuring the protection of economic interests, enhancing compliance with regulations, and protecting society from the negative effects of these prohibited practices. The prosecution clarified that concealment is an agreement or arrangement that allows a non-Saudi person to engage in an economic activity in the Kingdom that they are not licensed to practice, using the license or approval issued to the concealer.
The National Program for Combating Commercial Concealment recently conducted 2,305 inspection visits to ensure compliance in public benefit markets and to verify the absence of violations of the Anti-Concealment Law.
The visits covered all regions of the Kingdom, resulting in the detection of 65 cases of suspected commercial concealment, and the violators were referred to the relevant authorities for verification and the application of deterrent penalties against them.
National Anti-Concealment Program
The work of the National Program for Combating Commercial Concealment involves ensuring the legality of commercial establishments' operations and their compliance with the Anti-Concealment Law.
Its tasks include receiving consumer complaints related to combating commercial concealment, investigating cases of concealment and suspected cases, collecting evidence and hearing testimonies, and coordinating and cooperating with other entities regarding issues related to combating commercial concealment.
